A constitution could be defined as the fundamental laws customs, conventions, rules and regulations stipulating how a country is governed. The constitution also explains the working of the organs of government, the functions of the government functionaries and the rights, duties and obligations of its citizens. 

while The term constitutionalism refers to a limited government. It means that the power of government should be defined and limited by the laws of the land as embodied in the constitution. The activities and functions of those in government should conform with the provisions of the constitution. The constitution, therefore, has succeeded in describing the different organs of government, their functions and how they relate to one another . Constitutionalism as a principle is not a constitution but only puts limitation to the activities of individuals and the government etc. This principle also empowers the judiciary to declare illegal or unconstitutional actions of those in government that contradict with the provisions of the constitution. Individuals also can challenge any actions of government seen as unconstitutional in courts.

(1) There must be independent and impartial judiciary.

(ii) The Fundamental Human Rights must be recognised and protected.

(iii) There is the existence of party systems e.g two-party, multi-party systems.

(iv) Everybody should be equal before the law.

(iv)The application of the principles of separation of powers.

(v) Citizens have equal political rights to vote and be voted for in any political election.

(vii) There should be freedom of the press, no censorship.

(viii) The procedure for changing government should be entrenched in the constitution.

(ix) There should be the application of the rule of law as contained in the constitution.

Right of citizens are legal claims or entitlements, which every citizen enjoys in Nigeria as a country and which the state has duty to protect and guarantee.

(i) Right to life: This means that every human being has right to live. This right is inalienable.

(ii) Right to dignity of human person: This means that every human being must be respected and accorded dignity befitting a human person.

(iii) Right to personal liberty: This recognises freedom from unlawful arrest and intimidation.

(iv) Right to fair hearing: This recognizes the right to enjoy equality and fair hearing in law court. Both the rich and the poor must enjoy fair hearing. There should be no discrimination based on class, wealth and privileges.

(v) Right to private and family life: This means that every human being is entitled to enjoy family life, without disturbance. Right to privacy denotes that every human being should not be disturbed in his enjoyment of privacy.

(vi) Right to freedom of thought, conscience and religion: Every human being has the right to any religion of his choice in addition to enjoyment of freedom of thought and conscience.

Political participation involves a voluntary participation of individuals or citizens in the political activities of their country. It is a situation process where the citizens have the opportunity of electing their political leaders and taking part in the decision making in their country.

(b)
(i) Contesting elections: This is one form of political participation. The individual or a citizen can stand as a candidate for an elective post to represent his party.

(ii) Joining and belonging to political parties: The individual is actively involved in politics. He takes part in all activities e.g. campaigns, rallies, etc.

(iii) Holding of public offices: The citizen participates in politics by holding public office and this affords him the opportunity of contributing to the decision - making process of his country.

(iv) Sponsoring of political parties: A wealthy individual may not be active politically, but may sponsor a political party and this makes him participate politically.

(v) Partial participation: A citizen may be active politically by attending or taking part in political activities e.g. rallies, conventions, etc. Some also write on political issues in the newspapers.

(vi) Observatory posture: Here, the individual is an observer. He may not belong to any political party but may have interest in politics only by listening to discussions on political issues.

(vii) As a voter: Voting in elections makes an individual to be involved or to participate in politics.

(viii) As a polling agent: A citizen representing his party at the polls is actively involved in politics.

(ix) Demonstration: When citizens take part in demonstration on national issues, they participate in politics.

(i) There was a breakdown of the existing links between them and their people when the former became appendages of an alien government.

(ii) The introduction of wage earning gave their subjects economic independence.

(iii) The impact of Western education led to the breakdown of traditional norms and values of the society.

(xi) Emergence of political parties after World War II led to the decline of powers of the traditional rulers.

(xii) Appointment and deposition of traditional rulers by colonial authorities led to decline in their prestige.

(i) The constitution introduced elective principles which for the first time allowed Nigerians to elect their representatives to the legislative council

(ii) It paved way for the formation of political parties in Nigeria.

(iii) More Africans were allowed into the legislative council.

(iv) It was the first written constitution for Nigeria.

(v) It established a constitutional government in Nigeria as opposed to government by statutory instrument or orders.

 *DEMERITS*
(i)The British still dominated the Legislative Council.

(ii) Majority of the members of the Legislative Council were nominated, not elected.

(iii) The Executive Council was made up of officials to the exclusion of Nigerians.

(iv) The application of the elective principle was limited to Lagos and Calabar.

(v) The Constitution limited its jurisdiction only to the Southern provisions.
